This is a suit to determine the enforceability of a premarital agreement, entered into in 1977, under section 5.41 of the Texas Family Code and article XVI, section 15, of the Texas Constitution. The trial court granted summary judgment to Lillian Beck, holding that the premarital agreement at issue was enforceable under the 1948 amendment to article XVI, section 15, of the Texas Constitution. The court of appeals affirmed the trial courts judgment. 792 S.W.2d 813. We affirm the judgment of the court of appeals, but for different reasons.
